WAIVER AND RELEASE OF LIABILITY

I, the “Participant”, agree to take part in the Soul Line Dancing event offered by LJ Fitness Services, LLC (hereinafter referred to as the “Company”) on the premises of either (a) Vivid Affairs LLC Event Center located at 747 Davis Road, Suite 400, Stockbridge, GA 30281, and/or (b) Posh Venue located at 5353 N Henry Blvd, Suite 103, Stockbridge, GA 30281 (both locations hereinafter referred to as the “Properties”) as of the date signed below. This shall include all future participation dates hosted by the Company at the Properties or any other location. I recognize that this class, special event, and any other specialty class format offered by the Company that I participate in may involve strenuous physical activity which includes cardiovascular conditioning, muscle toning, and other various fitness activities. I hereby affirm that I am in good physical condition and do not suffer from any known disability or condition which would prevent or otherwise limit my full participation in this fitness class program or any other special event.

In addition, I am fully aware of the risks and hazards connected with my participation in any of the class programs or events offered by the Company including, but not limited to, physical injury or even death. I hereby elect to voluntarily participate in this program/event entirely at my own risk and assume full responsibility for any risks associated with my participation which may include, but are not limited to: physical and/or personal injury such as muscle strains, pulls or tears, broken bones, knee and back injuries, other bodily injuries, contraction of a contagious disease, illness, or virus including, but not limited to COVID-19, heart attacks, soreness, temporary or permanent disability including paralysis, death, psychological and/or emotional injury, economic and/or emotional loss, and property damage. I understand these injuries or outcomes may arise from my own or others’ negligence, conditions related to traveling to and from the Properties, or from other conditions associated with the Properties. Nonetheless, I assume all related risks, both known and unknown to me, due to my participation.

Furthermore, I agree to fully release, waive, and forever discharge the Company, its affiliates, employees, members, volunteers, consultants, heirs, representatives, predecessors, successors, and assigns (collectively referred to hereinafter as “Releasees”), from any claims brought against them, including losses and/or injuries I may suffer as a result of my participation or attendance at a hosted event. I also agree to indemnify, defend, and hold harmless the Releasees against any and all claims, suits, or actions of any kind whatsoever for liability, damages, compensation, or otherwise brought by me or anyone on my behalf (such as immediate family members, relatives, heirs, executors, administrators or assigns, and personal representatives) including attorney’s fees and any related costs.

I also give my consent to the Releasees to photograph and video record my image and likeness to be used and distributed for promotional purposes, including for the marketing and advertising of the Company’s programs, special events, and services, without compensation, residual obligations, reservations or limitations, or further approval. This authorization shall continue indefinitely, unless I otherwise revoke this authorization in writing to the Company. I further agree to indemnify and hold harmless the Releasees for any claims associated with such grant and right to use. I understand that my participation is voluntary and that I may, at any time, discontinue my involvement before signing this agreement.  

In signing this waiver and release, I acknowledge and represent that I have read and understand the foregoing and hereby sign it voluntarily as my own free act and deed. No oral representations, statements, or inducements, apart from the foregoing written agreements have been made. I hereby execute this waiver and release for valuable consideration, intending to be bound by the same.
